Terms and conditions

These Terms and Conditions (the “Terms”) apply to the TolSim website at tolsim.com and to the eSIM plans and related digital services offered through it (together, the “Services”).

The Services are supplied by Skyline Solutions UAB, registration number 306947870, with its registered address at Giedraičių g. 39-R53, Vilnius, LT-09302, Lithuania (“TolSim”, “we”, “us” or “our”). You can contact us at [email protected].

Please read these Terms before placing an order. By ordering or using a Service, you agree to these Terms. If you order for an organisation, you confirm that you have authority to bind it.

1. Who may use TolSim

You must be at least 18 years old and legally able to enter into a contract. You are responsible for keeping your account credentials secure and for activity carried out through your account.

We may ask for information reasonably needed to verify an order, prevent fraud, satisfy legal requirements or respond to a request from a payment partner. An order may be declined or cancelled if the required checks cannot be completed.

2. What TolSim provides

TolSim resells digital eSIM connectivity sourced through telecommunications operators and eSIM platform providers. Each plan’s destination or region, data allowance, validity period and any plan-specific conditions are displayed before purchase. Those product details form part of your contract with us.

An eSIM is delivered electronically. There is no physical SIM card or shipment. Network access is supplied through third-party operator infrastructure, so available networks, speeds, latency and signal strength can differ by place, device, congestion and local conditions.

3. Checks to make before ordering

Before buying, you must confirm that:

  • your device supports eSIM installation;
  • the device is network-unlocked;
  • the plan covers the intended destination or region;
  • the plan’s allowance and validity meet your needs; and
  • no device, operator or local restriction prevents use of the Service.

Compatibility information is guidance rather than a substitute for checking the exact device model and regional variant with its manufacturer or current mobile operator.

4. Orders, prices and payment

Prices and applicable taxes are shown at checkout before you pay. The available checkout currencies are euro (EUR) and British pound sterling (GBP). If your payment account uses another currency, its provider may apply its own exchange rate or fee.

Payments are handled by payment or acquiring partners. TolSim does not store full payment-card details. Strong customer authentication or additional transaction verification may be required.

Submitting an order is an offer to purchase the selected plan. We accept that offer when payment is authorised and the eSIM credentials are issued. We will provide an order confirmation electronically.

We may change prices for future orders, but a change will not alter the confirmed price of an accepted order.

5. Digital delivery and the withdrawal point

This section sets the controlling rule for delivery, cancellation and withdrawal across TolSim’s policies.

When you choose immediate supply, you ask us to begin digital performance without waiting for the end of any statutory withdrawal period. The eSIM is delivered once its unique access material is issued to you or made available through the delivery channel connected with your order. That material may be a QR code, activation link, eID, eSIM profile or other installation credentials. Delivery does not depend on whether you later activate the plan or consume data.

Before credentials are issued or delivered, a consumer may request cancellation and withdrawal within 14 calendar days after purchase. Eligibility is subject to verification with our systems and upstream provider that the credentials have not been generated, downloaded, installed, scanned or activated.

Once the credentials have been delivered, the order is treated as supplied and cancellation for change of mind is generally unavailable. Where applicable law requires your express consent to immediate supply and acknowledgement of the resulting loss of a withdrawal right, we will seek them as part of the purchase process. Nothing in these Terms removes a withdrawal right where the legal conditions for its loss have not been met.

The end of a change-of-mind right does not remove remedies for a non-conforming or technically defective Service. Section 9 explains those remedies, and the Refund Policy and Cancellation Policy provide the request procedures.

6. Installation, activation and validity

Follow the instructions supplied with your plan. A QR code or other credential may be limited to one installation, so do not scan, share or expose it unnecessarily.

The product page or activation instructions state when a plan’s validity begins. Depending on the plan, validity may start on installation, activation, first connection to a supported network or another stated event. The upstream operator’s records determine activation, validity and data consumption unless those records are shown to be incorrect.

You are responsible for device settings, including selecting the correct eSIM for mobile data and enabling data roaming where the plan instructions require it. Removing an installed eSIM may make it impossible to reinstall.

7. Network availability

Connectivity depends on networks that TolSim does not operate. Coverage maps, destination lists and speed descriptions are estimates rather than guarantees of service at every address or time. Maintenance, congestion, terrain, buildings, roaming arrangements, regulation and events outside reasonable control can affect access.

We may make reasonable technical changes or carry out maintenance. If an upstream operator changes a material technical constraint, we may pass that information to affected users.

8. Rules for using the Service

You may use the Website and eSIM only for lawful personal or business connectivity. You must not:

  • resell, transfer or share an eSIM profile without our written approval;
  • use the Service for fraud, spam, traffic pumping, unlawful communications or infringement of another person’s rights;
  • conduct mass or automated activations, bypass plan limits, or interfere with the Website, networks or security controls;
  • misuse payment instruments or provide false verification information; or
  • use the Service in breach of sanctions, export controls, operator fair-use requirements or local law.

We or an upstream operator may restrict or suspend a Service where reasonably necessary to address prohibited use, security risk, fraud, legal obligations or harm to a network. Where appropriate, we will notify you and allow a reasonable opportunity to correct the issue.

9. Faulty digital services and support

If credentials do not arrive, do not install, or the Service appears technically defective, contact [email protected] promptly. Include the order number, device model, destination, a description of the problem and any non-sensitive diagnostic information requested by support. Do not send passwords or full payment-card details.

We may troubleshoot the device configuration and ask the upstream provider to check delivery, profile status, activation records and network logs. If the provider verifies a defect in the eSIM or Service and the problem was not caused by device incompatibility, a network lock, inadequate local coverage, local restrictions, incorrect configuration or other user error, we will provide the repair, replacement, refund or other remedy required by applicable law. A refund may also be offered under the Refund Policy where appropriate.

10. Refund and cancellation requests

The Refund Policy explains refund eligibility, exclusions, evidence and processing. The Cancellation Policy explains how to stop an order before credentials are issued. Both policies form part of these Terms. If their wording conflicts with Section 5, Section 5 controls, except to the extent mandatory law provides a more favourable consumer right.

Approved refunds are returned to the original payment method. Do not start a chargeback as a substitute for contacting support about a genuine service issue. This does not prevent you from using any dispute or payment remedy available under law or card-scheme rules.

11. Third-party infrastructure

The Services depend on telecommunications operators, eSIM platform providers, hosting services and payment partners. Their technical limits and fair-use controls may affect performance. TolSim remains responsible for its own obligations to you and does not exclude responsibility that applicable law places on a trader for services supplied through third parties.

Links to external websites are provided for convenience. Their content and terms are controlled by their respective operators.

12. Our rights concerning orders

We may refuse or cancel an order before or after acceptance where payment is not authorised, information is materially inaccurate, the plan cannot be supplied, fraud or misuse is reasonably suspected, or supply would breach law or an operator restriction. If we cancel without fault on your part and no Service has been supplied, we will return the amount paid. If supply has already occurred, any refund will depend on the circumstances, these Terms and mandatory law.

13. Intellectual property

The Website, branding, text, graphics and software are owned by TolSim or its licensors and are protected by intellectual-property law. You receive only the limited right to access the Website and use a purchased Service in accordance with these Terms. No ownership rights are transferred to you.

14. Disclaimers and liability

We provide the Service with the level of skill and care required by law. Subject to those obligations, we do not promise uninterrupted connectivity, a particular speed, or coverage at every location.

To the fullest extent permitted by law, TolSim is not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was made. For claims to which a lawful financial cap may apply, our total liability is limited to the greater of EUR 100 or the fees you paid to us for Services during the three months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Nothing limits mandatory rights or remedies available to consumers.

You are responsible, to the extent permitted by law, for loss caused by your unlawful use of the Service, deliberate misuse of networks, or material breach of Section 8.

15. Compliance and restricted locations

Services may be unavailable in a country or region because of sanctions, export controls, telecommunications regulation or operator restrictions. You must not purchase, activate or use a Service where doing so is unlawful. We may deny or end supply when reasonably necessary to comply with these restrictions.

16. Changes to these Terms

The Terms in effect when we accept an order govern that order. We may update these Terms for future orders and will post the revised version with a new date. If a change must affect an existing Service for legal, security or technical reasons, we will provide reasonable notice where practicable and will not reduce mandatory consumer rights.

17. Governing law and disputes

These Terms and any non-contractual dispute are governed by Lithuanian law. The courts of Lithuania have jurisdiction, subject to any mandatory rule that allows a consumer to bring or defend proceedings in the courts of their country of residence or gives the consumer the protection of that country’s mandatory law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Please contact us first so that we can try to resolve a concern. This informal step does not shorten any legal limitation period or restrict access to a competent court or consumer authority.

18. General provisions

If a court finds part of these Terms invalid or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver of it. You may not transfer your contract without our consent; we may transfer our rights or obligations only where doing so does not reduce your legal protections. These Terms, the confirmed plan details and the policies incorporated above make up the agreement for your order.
